EU Delegated Regulation 2026/1310: New Construction Products Verification Systems

A new Construction Products Delegated Regulation — (EU) 2026/1310- was published in the Official Journal on 28 August 2026. It sets out how construction products are to be assessed and verified for conformity under the revised Construction Products Regulation.

Regulation (EU) 2024/3110 provides the framework for assessing construction product performance and conformity with applicable product requirements. Delegated Regulation (EU) 2026/1310 puts that framework into practice, product family by product family.

The Six Assessment and Verification Systems

Under Article 10 of Regulation (EU) 2024/3110, assessment and verification of a product's performance uses one or more of the systems set out in Annex IX. There are six:

• System 1+: the notified body carries out the assessment and verification tasks assigned to it, including audit testing of samples taken before the product is placed on the market.
• System 1: the notified body carries out the assessment and verification tasks assigned to it, without the audit testing required under System 1+.
• System 2+: the notified body certifies the manufacturer's factory production control, while the manufacturer carries out the other assigned tasks.
• System 3+: the notified body carries out the assessment and verification of the environmental sustainability assessment, while the manufacturer carries out the other tasks.
• System 3: the notified body assesses the product's performance, while the manufacturer carries out the other tasks.
• System 4: the manufacturer carries out all assessment and verification tasks, with no task for a notified body.

Horizontal Characteristics Under Annex X

The CPR also addresses essential characteristics of a horizontal nature in Annex X — characteristics considered across different product families, rather than limited to one specific type of construction product. Annex X groups them into six areas:

• Reaction to fire
• Resistance to fire
• External fire performance
• Noise absorption
• Release and content of dangerous substances
• Environmental sustainability

What Delegated Regulation (EU) 2026/1310 Actually Does

Delegated Regulation (EU) 2026/1310 takes this framework and establishes which assessment and verification systems apply to different construction product families and categories. It does this through three annexes.

Annex I: Deemed-to-satisfy provisions
Annex I covers cases where a delegated act allows certain performance levels or classes to be achieved without testing, or without further testing. In these cases, System 4 applies under the conditions set out in that delegated act.

Annex II: Horizontal essential characteristics
Annex II applies assessment and verification systems to four of the six horizontal characteristic groups from Annex X: reaction to fire, external fire performance, release and content of dangerous substances, and environmental sustainability. The table contains 10 assessment situations, including situations applying to all product families and a specific case for product family 31.

Annex III: Product families and categories
Annex III covers 35 product families across 246 product-family/category rows, setting out the applicable assessment and verification system based on product category, intended use, essential characteristics and product requirements.

Different assessment and verification systems can apply within the same product family or category, depending on the specific essential characteristic or product requirement. Where a characteristic falls under Annex I's deemed-to-satisfy provisions, that system takes precedence over both other annexes; where it falls under Annex II, that system takes precedence over Annex III.

When Does It Apply?

Delegated Regulation (EU) 2026/1310 enters into force on the twentieth day following its publication in the Official Journal — 17 September 2026.
